Artāwhai Founding Artist Beta Terms

1. The beta

Artāwhai is an early-stage global platform for human-made art. Features may change, pause or be removed during testing. Participation is voluntary and the beta is provided without a promise of uninterrupted availability.

2. Accounts

Users must provide accurate information, protect their sign-in credentials and be legally able to agree to these terms. Accounts may be restricted where needed to protect people, rights or the platform.

3. Artist content and ownership

Artists retain ownership of their artwork and copyright. By publishing, the artist gives Artāwhai a non-exclusive, worldwide, royalty-free licence during the account’s operation to host, reproduce, resize, display, format, create non-generative display versions, apply QR/provenance overlays, promote and make the content discoverable for operating and explaining Artāwhai. This licence ends after deletion within a reasonable technical period, except for lawful records, backups and material already shared outside Artāwhai.

4. Artist promises

Artists promise that their uploads are human-made, that they created the work or have authority to publish it, that supplied information is not knowingly false and that the content does not unlawfully infringe another person’s rights.

5. Enquiries and transactions

The current beta connects viewers and artists through enquiries. Artāwhai is not yet processing the sale, holding money, arranging delivery, authenticating physical works or guaranteeing either party. Artists and buyers are responsible for their own checks, agreements, payment, tax, shipping and safety.

6. Provenance and QR records

Artwork-specific QR codes connect displays to official Artāwhai records and support provenance and discovery. They are not, by themselves, absolute proof that a physical object is authentic, unchanged or owned by a particular person.

7. Moderation and removal

Artāwhai may review, hide or remove content and may request information where there are concerns about human authorship, rights, safety, misrepresentation or platform integrity. Good-faith reporting and a fair opportunity to respond are intended during beta.

8. Feedback

Participants may provide product feedback. Artāwhai may use that feedback to improve the platform without creating ownership, partnership, employment or payment rights for the person providing it.

9. Acceptable use

Users must not attack the platform, scrape it abusively, impersonate others, send spam, upload malware, misuse personal information, manipulate discovery dishonestly or use Artāwhai for unlawful conduct.

10. Responsibility and beta risk

Users remain responsible for their content, decisions and direct dealings. To the extent permitted by law, Artāwhai is not responsible for indirect loss or for conduct between users. Nothing in these terms excludes rights that cannot lawfully be excluded.

11. Changes and exit

Terms may be updated as the beta develops. Users can stop participating and remove artwork through the Artist Studio. Account-deletion support is available through Support.

12. Governing law

These beta terms are governed by the laws of Aotearoa New Zealand, subject to any mandatory rights that apply where a user lives.
